Terms of Service.

Welcome to PawGotchi: Fitness Companion. These Terms of Service ("Terms") govern your use of the PawGotchi mobile application ("App") provided by Raiser Software Inc. ("we", "our", or "us"). By using PawGotchi, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using PawGotchi, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

PawGotchi is a calorie- and workout-tracking app paired with a virtual mascot. The App lets you:

• Log foods, calories, macros, water, and weights
• Build and track workouts (sets, reps, weight, rest, personal records)
• Adopt and name a virtual bear who reflects your activity over time
• Earn coins and decorate a virtual room with furniture and outfits from a daily-rotating shop
• Optionally connect with friends to see each other's activity
• Subscribe to PawGotchi Pro to unlock Pic Scan, advanced stats, 2× coin earnings, and a larger daily shop rotation

3. Not Medical Advice

PawGotchi is a fitness and tracking tool, not a medical device or healthcare service. Calorie targets, macro suggestions, weight trends, and workout volume estimates are for informational purposes only. The App does not diagnose, treat, cure, or prevent any disease or condition. Always consult a qualified healthcare professional before starting a new diet, exercise routine, or weight-loss plan, particularly if you are pregnant, have a history of disordered eating, or have any medical condition that may be affected by changes in diet or activity.

Nutritional information shown in the App comes from a third-party food database and from entries created by you and other users. We do not guarantee its accuracy, completeness, or currency, and you should not rely on it to manage medical conditions such as diabetes, allergies, or food intolerances.

4. User Accounts

To use PawGotchi, you must create an account. You can sign in with email, Google, or Apple. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information, especially the health-profile inputs (height, weight, age) used to calculate your calorie targets

You must be at least 13 years old to create an account and use PawGotchi.

5. Acceptable Use

You agree not to use PawGotchi to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm other users in the friends feed
• Upload meal photos, profile photos, or other content that is illegal, obscene, hateful, or infringes on others' rights
• Attempt to gain unauthorized access to our systems, other users' accounts, or the in-app coin economy
• Use automation, scripts, or modified clients to inflate XP, coins, level, or quest completion
• Reverse-engineer, decompile, or attempt to derive the source code of the App, except where permitted by law
• Use the App for any commercial purpose without our permission
• Interfere with or disrupt the App's functionality

6. User Content

You retain ownership of content you create in PawGotchi (food log entries, custom recipes, meal photos, weights, workout history, your bear's name, and friends-feed posts).

We do not claim ownership of your content, but you grant us a limited, worldwide, royalty-free licence to store, display, transmit, and back up your content as necessary to operate the App and deliver it to you (and, where you choose, to friends you have added).

7. PawGotchi Pro Subscriptions

PawGotchi is free to download and use. PawGotchi Pro is an optional auto-renewing subscription that unlocks Pic Scan (photo-based food logging), advanced stats and analytics, 2× coin earnings on all activities, and a larger daily shop rotation (12 items per rotation versus 6 on the free tier).

• Pricing: $6.99 USD/month with a 3-day free introductory trial, or $44.99 USD/year with a 7-day free introductory trial. Trial offers are available only to users who have not previously subscribed to PawGotchi Pro. Local prices may vary by territory; the price shown in the App at the time of purchase is authoritative.
• Billing: Subscriptions are sold and billed by Apple (App Store) or Google (Google Play). Payment is charged to your Apple ID or Google account at confirmation of purchase.
• Auto-renewal: Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. If you do not cancel a free trial before it ends, the trial automatically converts to a paid subscription at the price shown at sign-up.
• Managing your subscription: You can manage and cancel your subscription in the Apple App Store or Google Play subscription settings on your device. Uninstalling the App does not cancel an active subscription.
• Refunds: Refunds are handled by Apple or Google according to their published policies. We do not directly issue refunds for App Store or Google Play purchases.
• If your subscription ends: Pro-only features (Pic Scan, advanced stats, 2× coin earnings, expanded shop rotation) become unavailable until you resubscribe. Your tracking data, your bear, your room, your earned coins, and all free features remain fully usable.

8. Virtual Items and the Coin Economy

Coins, XP, levels, furniture, outfits, and other in-app items have no real-world monetary value, are not transferable between accounts, and cannot be redeemed for cash. We may, at our discretion, adjust drop rates, the daily shop rotation, item prices, or game balance to keep the App fair and fun. We will not retroactively confiscate items you have already earned or purchased except where required to fix a bug or abuse.

9. Friends Feed

Where the friends feed is enabled in your version of the App, it is opt-in. By adding a friend, you agree that the activity events you choose to share (such as level-ups, completed workouts, PRs, and daily-quest completions) may be visible to that friend. You are responsible for the content you post and for treating other users with kindness. We may remove content and suspend accounts that violate Section 5.

10. Intellectual Property

PawGotchi, the bear, the room, the icon, the brand, and all original content, features, and functionality are owned by Raiser Software Inc. and are protected by international copyright, trademark, and other intellectual property laws.

11. Disclaimer of Warranties

PawGotchi is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free, or that calorie, macro, or step counts are accurate to a specific tolerance.

12. Limitation of Liability

To the maximum extent permitted by law, Raiser Software Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of PawGotchi or any decisions you make based on information shown in the App.

13. Account Termination and Data Deletion

You may delete your account and the data associated with it at any time through Settings → Account → Delete Account inside the App. If you cannot sign in, email support+pawgotchi@raisersoftware.com from the address associated with your account and we will complete the deletion within 30 days. Deletion is permanent and there is no recovery window today.

Deletion permanently removes your user profile, mascot, daily logs (food, water, weight, workouts), weigh-in records and progress photos, earned coins, XP, level, streak history, friend connections, friends-feed posts you authored, and your sign-in credentials. Some data is retained after deletion as required by law or in anonymized form — see the full breakdown in the Account & Data Deletion section at the top of this page. An active PawGotchi Pro subscription must be cancelled separately in the Apple App Store or Google Play subscription settings before deleting your account, otherwise billing continues under the App Store / Play Store's terms.

We also reserve the right to suspend or terminate accounts that violate these Terms, including for repeated abuse of the friends feed, attempts to manipulate the coin economy, or fraudulent subscription activity.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by updating the "Last updated" date. Continued use of PawGotchi after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

16. Apple App Store Additional Terms

The following additional terms apply if you downloaded PawGotchi from Apple's App Store. These terms are required by Apple's Developer Program License Agreement and are in addition to (and do not replace) the Terms above.

16.1 Acknowledgement

You and Raiser Software Inc. acknowledge that these Terms are concluded between you and Raiser Software Inc. only, and not with Apple Inc. ("Apple"). Raiser Software Inc., not Apple, is solely responsible for PawGotchi and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to PawGotchi.

16.2 Scope of License

The license granted to you for PawGotchi is limited to a non-transferable license to use PawGotchi on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that PawGotchi may be accessed and used by other accounts associated with the purchaser via Family Sharing, volume purchasing, or Apple's Legacy Contact program.

16.3 Maintenance and Support

Raiser Software Inc. is solely responsible for providing any maintenance and support services with respect to PawGotchi, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to PawGotchi.

16.4 Warranty

Raiser Software Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of PawGotchi to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for PawGotchi to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to PawGotchi, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Raiser Software Inc.

16.5 Product Claims

You and Raiser Software Inc. acknowledge that Raiser Software Inc., not Apple, is responsible for addressing any claims by you or any third party relating to PawGotchi or your possession and/or use of PawGotchi, including, but not limited to: (i) product liability claims; (ii) any claim that PawGotchi fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16.6 Intellectual Property Rights

You and Raiser Software Inc. acknowledge that, in the event of any third party claim that PawGotchi or your possession and use of PawGotchi infringes that third party's intellectual property rights, Raiser Software Inc., not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

16.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.9 Third Party Terms

You must comply with any applicable third-party terms of agreement when using PawGotchi (for example, your wireless data services agreement).

16.10 Third Party Beneficiary

You and Raiser Software Inc. acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
